The Uniform Determination of Death Act (UDDA) provides that “an individual who has sustained either (1) irreversible cessation of circulatory and respiratory functions or (2) irreversible cessation of all functions of the entire brain, including the brain stem, is dead.” We show that the UDDA contains two conflicting interpretations of the phrase “cessation of functions.” By one interpretation, what matters for the determination of death is the cessation of spontaneous functions only, regardless of their generation by artificial means. By the (...) other, what matters is the cessation of both spontaneous and artificially supported functions. Because each UDDA criterion uses a different interpretation, the law is conceptually inconsistent. A single consistent interpretation would lead to the conclusion that conscious individuals whose respiratory and circulatory functions are artificially supported are actually dead, or that individuals whose brain is entirely and irreversibly destroyed may be alive. Alireza Bagheri supports a policy on organ procurement where individuals could choose their own definition of death between two or more socially accepted alternatives. First, we claim that such a policy, without any criterion to distinguish accepted from acceptable definitions, easily leads to the slippery slope that Bagheri tries to avoid. Second, we suggest that a public discussion about the circumstances under which the dead donor rule could be violated is more productive of social trust than constantly moving the line (...) between life and death. The existence of fundamental moral disagreements is a central problem for moral realism and has often been contrasted with an alleged absence of disagreement in mathematics. However, mathematicians do in fact disagree on fundamental questions, for example on which set-theoretic axioms are true, and some philosophers have argued that this increases the plausibility of moral vis-à-vis mathematical realism. I argue that the analogy between mathematical and moral disagreement is not as straightforward as those arguments present it. In particular, I argue (...) that pluralist accounts of mathematics render fundamental mathematical disagreements compatible with mathematical realism in a way in which moral disagreements and moral realism are not. 11. This article presents the first, systematic analysis of the ethical challenges posed by recommender systems through a literature review. The article identifies six areas of concern, and maps them onto a proposed taxonomy of different kinds of ethical impact. The analysis uncovers a gap in the literature: currently user-centred approaches do not consider the interests of a variety of other stakeholders—as opposed to just the receivers of a recommendation—in assessing the ethical impacts of a recommender system.

Pluralist mathematical realism, the view that there exists more than one mathematical universe, has become an influential position in the philosophy of mathematics. I argue that, if mathematical pluralism is true (and we have good reason to believe that it is), then mathematical realism cannot (easily) be justified by arguments from the indispensability of mathematics to science. This is because any justificatory chain of inferences from mathematical applications in science to the total body of mathematical theorems can cover at most (...) one mathematical universe. This article analyses the ethical aspects of multistakeholder recommendation systems (RSs). Following the most common approach in the literature, we assume a consequentialist framework to introduce the main concepts of multistakeholder recommendation. We then consider three research questions: who are the stakeholders in a RS? How are their interests taken into account when formulating a recommendation? And, what is the scientific paradigm underlying RSs? Our main finding is that multistakeholder RSs (MRSs) are designed and theorised, methodologically, according to neoclassical welfare (...) economics. We consider and reply to some methodological objections to MRSs on this basis, concluding that the multistakeholder approach offers the resources to understand the normative social dimension of RSs. Drawing on Husserl, Ingarden and Levinas’ works, this article explores Ibsen’s Rosmersholm from a phenomenological perspective, aiming to shed light both on this play and on the phenomenology of hunger and theatre, as well as on the larger meaning of alimentary enjoyment.

It is well-established that algorithms can be instruments of injustice. It is less frequently discussed, however, how current modes of AI deployment often make the very discovery of injustice difficult, if not impossible. In this article, we focus on the effects of algorithmic profiling on epistemic agency. We show how algorithmic profiling can give rise to epistemic injustice through the depletion of epistemic resources that are needed to interpret and evaluate certain experiences. By doing so, we not only demonstrate how (...) the philosophical conceptual framework of epistemic injustice can help pinpoint potential, systematic harms from algorithmic profiling, but we also identify a novel source of hermeneutical injustice that to date has received little attention in the relevant literature: epistemic fragmentation. Epistemic fragmentation is a structural characteristic of algorithmically-mediated environments that isolate individuals, making it more difficult to develop, uptake and apply new epistemic resources. This, in turn, can impede the identification and conceptualisation of emerging harms in these environments. We trace the occurrence of hermeneutical injustice back to the fragmentation of the epistemic experiences of individuals, who are left more vulnerable by the inability to share, compare, and learn from shared experiences. Goal: To assess public knowledge and attitudes towards the family’s role in deceased organ donation in Europe. -/- Methods: A systematic search was conducted in CINHAL, MEDLINE, PAIS Index, Scopus, PsycINFO, and Web of Science on December 15th, 2017. Eligibility criteria were socio-empirical studies conducted in Europe from 2008 to 2017 addressing either knowledge or attitudes by the public towards the consent system, including the involvement of the family in the decision-making process, for post-mortem organ retrieval. Screening and data collection (...) were performed by two or more independent reviewers for each record. -/- Results: Of the 1482 results, 467 studies were assessed in full-text form, and 33 were included in this synthesis. When the deceased has not expressed any preference, a majority of the public support the family's role as a surrogate decision-maker. When the deceased expressly consented, the respondents' answers depend on whether they see themselves as potential donors or as a deceased's next-of-kin. Answers also depend on the relationship between the deceased and the decision-maker(s) within the family, and on their ethnic or cultural background. -/- Conclusions: Public views on the authority of the family in organ donation decision-making require further research. A common conceptual framework and validated well-designed questionnaires are needed for future studies. The findings should be considered in the development of Government policy and guidance regarding the role of families in deceased organ donation. (shrink)

This paper focuses on Foucault's concept of the Panopticon. The Panopticon since time immemorial has been used as a concept in order to control society. Since this is being used as a tool to control society, this then is considered to be a form of technology of which is being used by individuals who hold power.

I argue that recent attempts to deflect Access Problems for realism about a priori domains such as mathematics, logic, morality, and modality using arguments from evolution result in two kinds of explanatory overkill: the Access Problem is eliminated for contentious domains, and realist belief becomes viciously immune to arguments from dispensability, and to non-rebutting counter-arguments more generally.

Francis Bacon’s theory of matter is a controversial topic among historians. I agree with the viewpoint, which suggests that although Bacon changed his views on atomism repeatedly, he never rejected it completely (Partington, Urbach, Gemelli). I will substantiate this interpretation by paying more attention to the usually neglected allegorical works and by investigating why Bacon changed his mind on atomism in his Novum organum. I shall reconstruct Bacon’s various opinions in chronological order to establish his final evaluation of atomism and (...) his reasons for it. Given that Bacon never embraced a matter theory identical with Greek atomism, I shall here define atomism in the broadest sense, as a corpuscular matter theory that posits final and indivisible particles. Following this semantic delimitation, two successive Baconian opinions will be distinguished: the first took the atom to constitute an ontological and causative-operational principle; the second deprived the atom of this causative-operational ability, but did not touch its ontological priority. At the same time, I will investigate the question concerning the coexistence of atomism and pneumatism in Bacon’s theory, a point that has been discussed in the influential interpretations by Kargon and Rees. I shall argue that Bacon did not regard these two doctrines as incompatible. (shrink)

This book draws on Iris Murdoch's philosophy to explore questions related to the importance of attention in ethics. In doing so, it also engages with Murdoch's ideas about the existence of a moral reality, the importance of love, and the necessity but also the difficulty, for most of us, of fighting against our natural self-centred tendencies. Why is attention important to morality? This book argues that many moral failures and moral achievements can be explained by attention. Not only our actions (...) and choices, but the possibilities we choose among, and even the meaning what we perceive, are to a large extent determined by whether we pay attention, and what we attend do. In this way, the book argues that attention is fundamental, though often overlooked, in morality. While the book's discussion of attention revolves primarily around Murdoch's thought, it also engages significantly with Simone Weil, who introduced the concept of attention in a spiritual context. The book also engages with contemporary debates concerning moral perception and motivation, empirical psychology, animal ethics, and Buddhist philosophy. The Ethics of Attention will be of interest to researchers and advanced students working on Iris Murdoch, Simone Weil, ethics and moral psychology, and the philosophy of attention. (shrink)

Political fact-checkers evaluate the truthfulness of politicians’ claims. This paper contributes to an emerging scholarly debate on whether fact-checkers treat political parties differently in a systematic manner depending on their ideology (bias). We first examine the available approaches to analyze bias and then present a new approach in two steps. First, we propose a logistic regression model to analyze the outcomes of fact-checks and calculate how likely each political party will obtain a truth score. We test our model with a (...) sample of fact-checks from Newtral, a major Spanish fact-checker. Our model would signal bias under two assumptions: a) all political parties are on average equally accurate in their statements; b) the verification method gives precise instructions and is implemented systematically. We investigate this second assumption with a series of interviews with Newtral fact-checkers. We show that standard verification protocols are so loosely implemented that fact-checks reflect a set of journalistic decisions, rather than a bias in the statistical sense. We call for a more rigorous definition of verification methods as a pre-requisite for an unbiased assessment of politician’s claims. (shrink)

Maimonides famously holds that, while it is perfectly possible to know (and say) that God exists, it is impossible to know (and say) what God is like because any positive attri- bution contradicts God’s essential oneness. Consequently, pure equivocity obtains between descriptions of the divine and descriptions of any other being. But this raises a puzzle: Knowledge of God seems vacuous if we lack all comprehension of God’s nature - so how can we have any comprehension of the divine without (...) being able to say what it is that we know? In this essay, I defend the substantiality of the concept of knowledge of God on Maimonides’ apophatic picture. Drawing on the concept of non-propositional knowledge, I argue that knowledge and comprehension can come apart, which lends support to Maimonides’ thesis that knowledge of God, though substantial and objective, cannot be expressed. On the one hand, it appears to be one of the keys, if not the key, to goodness, the task of the moral subject, and the pre-requisite for right action. On the other, attention can function as the hinge around which Murdoch’s general ethical worldview (including psychology and metaphysics) can be made to revolve, and through which it turns away from the mainstream contemporary philosophy of her time. Hace un tiempo G. Rees señaló la importancia del razonamiento cuantitativo en el programa de la renovación del saber propuesto por F. Bacon, renovando la imagen tradicional de su método. Con la intención de proseguir el replanteo iniciado por Rees de los conceptos centrales del método baconiano, me propongo reexaminar el significado de la experimentación y de los instrumentos científicos, lo cual implica al mismo tiempo considerar la relación entre razón y sentidos. Para ello, examinaré el significado de los sentidos (...) como fuentes del conocimiento, la función de la experimentación y de los instrumentos para superar las limitaciones de los sentidos, la inserción de datos cuantitativos en el marco experimental, el concepto de sutilidad de la naturaleza y el sentido metodológico de la anatomía baconiana. Como conclusión señalo que en el método baconiano los sentidos están subordinados a la razón, ya que tanto los experimentos como los instrumentos científicos están sujetos a la autoridad de la razón para alcanzar la verdad y evitar sus errores. Laura Specker Sullivan (2022) makes a fairly compelling case for the value of the perspectives of Buddhist practitioners in neuroethics. In this study, Tibetan Buddhist monks have been asked, among other things, whether consciousness, in brain-injured patients in a minimally conscious state, entails a duty to preserve life. In our view, some of the participants’ responses could be used to inform the bioethical debate on death determination.

In the last few decades, the historiographical categories rationalism and empiricism have been criticized for their limitations to explain the complex positions and the links held by the philosophers tradiotnally attached to them. This narrative was firstly conceived by Kantian German historians and began to become standard at the turn of the twentieh century. Nonetheless, nineteenth-century French historiography developed other narratives by which early modern philosophers were classified according to alternative criteria. In the first edition of Histoire comparée des systémes (...) de philosophie (1804), Joseph-Marie Degérando distinguishes three first-order early modern schools founded by Bacon, Descartes and Leibniz, respectively. Degérando introduces the empiricism and rationalism distinction as one among others, and not as the fundamental one. In addition, he separates empiricism from experimental philosophy. The last one, along with speculative philosophy, is said to conciliate senses and reason. As a result, this account offers philosophical groupings different from those constructed by the standard narrative. Furthermore, it draws on labels and classification criteria which were part of the early modern philosophical discourse. (shrink)

The aim of this paper is to offer a comparative survey of Bacon's theory and practice of natural history and of civil history, particularly centered on their relationship to natural philosophy and human philosophy. I will try to show that the obvious differences concerning their subject matter encompass a number of less obvious methodological and philosophical assumptions which reveal a significant practical and con ceptual convergence of the two fields. Causes or axioms are prescribed as the theoretical end-products of natural (...) history, whereas precepts are envisaged as the speculative outcomes derived from perfect civil history. In spite of this difference, causes and precepts are thought to enable effective action in order to change the state of nature and of man, respectively. For that reason a number of common patterns are to be found in Bacon's theory and practice of natural and civil history. (shrink)

L’identité et la datation de Nicolas le Péripatéticien, l’auteur d’un sommaire de la philosophie d’Aristote, ont fait l’objet d’un article récent de Silvia Fazzo paru dans la Revue des Études Grecques. Contre la datation courante, fondée sur l’identification de Nicolas à l’historien de grand renom Nicolas Damascène , Fazzo a montré que Nicolas avait probablement vécu au cours de la période couvrant les IIIe au Ve siècles ap. J.-C., et plus problablement à l’époque de l’empereur Julien l’Apostat . Cette (...) hypothèse trouve un appui dans un nouveau fragment en traduction hébraïque découvert par Mauro Zonta, dans lequel Nicolas cherche à expliquer la Trinité de Dieu au moyen de la doctrine aristotélicienne des causes: Dieu est un, en tant que sa substance est une, mais Dieu est également trois, puisqu’il est à la fois causes motrice, formelle et finale du monde. In this chapter we will argue, firstly, that Bacon’s engages in a pecu-liar form of mathematization of nature that develops a quali-quantitative methodology of measurement. Secondly, we will show that medicine is one of the disciplines where that dual way of measurement is practiced. In the first section of the chapter, we will expose the ontology involved in the Baconian proposal of measurement of nature. The second section will address the place that mixed mathematics occupies in Bacon’s scheme of scientific (...) branches and will suggest that a proper advancement of medicine can generate a new branch of mixed mathematics. The next section will reconstruct Bacon’s approach to measurement and expose its quali-quantitative import. In the last section, we will show some examples of medicine in which this quali-quantitative measurement is applied. (shrink)

In presenting self-preservation as the most general law of nature, set at the summit of the structure of the natural world, Francis Bacon characterized the universal appe- tite for self-preservation as an innate instinct which, in the case of living beings, is primarily associated with the emotion of fear. Bacon’s philosophy offers several tech- niques of self-care to manage the fear of accidents of fortune from which the existence and well-being of the self is under constant threat. This article reconstructs (...) Bacon’s treatment of divinatory arts and their contributions to self-care. We will explore how he adopts traditional divinatory arts and reforms them: oneirocritics, physiognomy, and astrology. We will contend that Bacon’s approach to divinatory arts as techniques for self-care and the management of fortune shows some salient points shared with his natural philosophy: in both cases, the approach is hermeneutical, with the goal of exerting human power. With regard both to nature and to fortune, however, our power to modify the state of things extends only so far. The range of decisions we can make is not unlimited but encompasses only what is “in our power,” that is, what depends on us. (shrink)

The dominion over nature and the instinct for self-preservation are the central elements of the theoretical framework within which they inserted their assessments of medicine. Medicine is valued as the most outstanding discipline for its benefits for the care of the human being. In the period of emergence of early modern science, ‘monsters’ or individuals with physical congenital anomalies were considered as rare events which required special explanations entailing assumptions about the laws of nature. This concern with monsters was shared by representatives of the new science and Late Scholastic authors of university textbooks. This paper will reconstruct the main theses of the treatment of monsters in Late Scholastic textbooks, by focusing on the question as to how their accounts conceived nature’s regularity and (...) teleology. It shows that they developed a naturalistic teratology in which, in contrast to the naturalistic explanations usually offered by the new science, finality was at central stage. This general point does not impede our noticing that some authors were closer to the views emerging in the Scientific Revolution insofar as they conceived nature as relatively autonomous from God and gave a relevant place to efficient secondary causation. In this connection, this paper suggests that the concept of the laws of nature developed by the new science –as exception-less regularities—transferred to nature’s regularity the ‘strong’ character that Late Scholasticism attributed to finality and that the decline of the Late Scholastic view of finality played as an important concomitant factor permitting the transformation of the concept of laws of nature. In this paper I consider Simone Weil’s notion of attention as the fundamental and necessary condition for mystical experience, and investigate Iris Murdoch’s secular adaptation of attention as a moral attitude. After exploring the concept of attention in Weil and its relation to the mystical, I turn to Murdoch to address the following question: how does Murdoch manage to maintain Weil’s idea of attention, even keeping the importance of mysticism, without Weil’s religious metaphysical background? Simone Weil returns to the importance (...) of attention throughout her writing. To attend, for Weil, means to empty oneself of all that is personal, primarily one’s will, which Weil sees as the essence of the human individual. This act imitates God’s act of creation, considered as a withdrawal in order to let something other than himself exist. Since such withdrawal represents God’s supreme act of love, salvation for human beings lies in the attempt to do likewise. By giving up one’s will, while desiring God with all of one’s soul, one creates the conditions for God to descend into the soul. This ‘passive activity’ is attention. Weil’s writings had a deep impact on Iris Murdoch’s moral philosophy. In particular, Weil’s concept of attention is carried into Murdoch’s thought almost unchanged, with one striking exception: the absence of God in Murdoch’s system. Just as surprisingly, Murdoch at the same time maintains that mysticism and spirituality are crucial for morality, nor does she wish to sever the connection between attention and mysticism. Is Murdoch being inconsistent? I believe not. But the idea of attention as a mystical concept, within a metaphysics which has no room for God, requires further examination. For Murdoch, attention is the central capacity of the morally good person. Attention is, like in Weil, connected with an emptying of the self (for Murdoch the Ego) and a renunciation of will, in order to let something external make an impression in the subject. However, in Murdoch’s philosophy such external impression is not given by God, but by reality itself. Thus far, it appears, the notion of mysticism would be unnecessary. Yet for Murdoch reality is not something that we passively perceive, but something that requires a moral faculty – attention – made up of selflessness and desire for the good, in order to be apprehended. Two elements of mysticism then begin to surface: firstly, apprehension of reality requires a faculty that is not purely intellectual, but that involves the whole of the individual, including intuitions that one may be unable to explain (which Murdoch is happy to call ‘the soul’); secondly, the reality thus apprehended is considered as transcendent, insofar as its truth, infinitely distant, transcends the individual’s complete grasp. Thus the mystic, in Murdoch’s system, is regarded as an ideal moral person, not because s/he is guided by God, but because of his/her selfless ability to attend to the world beyond oneself and intuit its moral and metaphysical truth. The aim of this paper is to examine how much Hume knew about astronomy, in order to understand the reasons for his acceptance of Copernicanism. My contention is that Hume’s positive reception of the Copernican system arises at least from the importance that he gives to three features that he attributes to the Copernican system: beauty, simplicity and uniformity. I also give some evidence that Hume had first-hand knowledge of some sections of Galileo’s Dialogo sopra i due massimi sistemi del (...) mondo tolemaico e copernicano (1632), where the “sole proofs” of the Copernican system are said to be found. The first part of this paper will provide a reconstruction of Francis Bacon’s interpretation of Academic scepticism, Pyrrhonism, and Dogmatism, and its sources throughout his large corpus. It shall also analyze Bacon’s approach against the background of his intellectual milieu, looking particularly at Renaissance readings of scepticism as developed by Guillaume Salluste du Bartas, Pierre de la Primaudaye, Fulke Greville, and John Davies. It shall show that although Bacon made more references to Academic than to Pyrrhonian Scepticism, like most of (...) his contemporaries, he often misrepresented and mixed the doctrinal components of both currents. The second part of the paper shall offer a complete chronological survey of Bacon’s assessment of scepticism throughout his writings. Following the lead of previous studies by other scholars, I shall support the view that, while he approved of the state of doubt and the suspension of judgment as a provisional necessary stage in the pursuit of knowledge, he rejected the notion of acatalepsia. To this received reading, I shall add the suggestion that Bacon’s criticism of acatalepsia ultimately depends on his view of the historical conditions that surround human nature. I deal with this last point in the third part of the paper, where I shall argue that Bacon’s evaluation of scepticism relied on his adoption of a Protestant and Augustinian view of human nature that informed his overall interpretation of the history of humanity and nature, including the sceptical schools. [ENGLISH] This article discusses the potential of synthetic biology to address fundamental questions in the philosophy of biology regarding the nature of life and biological functions. Synthetic biology aims to reduce living organisms to their simplest forms by identifying the minimal components of a cell and also to create novel life forms through genetic reprogramming, biobrick assembly, or novel proteins. However, the technical success of these endeavors does not guarantee their conceptual success in defining life. There is a lack of (...) consensus among researchers on how to define and classify the entities produced in the lab, whether they should be considered living or categorized differently. The criteria for minimal cells and minimal life are subject to arbitrary choices and varying interpretations. The concept of function, crucial to synthetic biology, is also difficult to define. The article highlights the need to consider the minimal set of functions that characterize life before determining the smallest genomes that code for those functions. The arbitrary nature of defining both life and function complicates the understanding and classification of these entities. The article suggests that the traditional dichotomy between the living and the non-living may no longer be valid and that the concept of life itself may not require precise scientific definition. As synthetic biology advances, the article emphasizes the importance of redefining or constructing new categories to encompass the expanding possibilities and creations in the field. The ability to create new life forms raises questions about recognition, identification, and ethical implications, requiring a conceptual and philosophical engagement beyond the technical achievements of synthetic biology. -/- [FRENCH] L'article aborde le potentiel de la biologie synthétique pour répondre à des questions fondamentales de la philosophie de la biologie concernant la nature de la vie et des fonctions biologiques. La notion de fonction, essentielle en biologie synthétique, est également difficile à définir. L'article met en évidence la nécessité de prendre en compte l'ensemble minimal de fonctions qui caractérisent la vie avant de déterminer les plus petits génomes qui codent ces fonctions. La nature arbitraire de la définition de la vie et de la fonction complique la compréhension et la classification de ces entités. L'article suggère que la dichotomie traditionnelle entre le vivant et le non-vivant pourrait ne plus être valable et que le concept même de vie ne nécessite pas une définition scientifique précise. À mesure que la biologie synthétique progresse, l'article souligne l'importance de redéfinir ou de construire de nouvelles catégories pour englober les possibilités et créations croissantes dans le domaine. La capacité à créer de nouvelles formes de vie soulève des questions de reconnaissance, d'identification et d'implications éthiques, nécessitant une réflexion conceptuelle et philosophique au-delà des avancées techniques de la biologie synthétique. Solidamente formado na cultura humanista de seu tempo, Bacon adotou com destreza os recursos da retórica e nutriu-se de um amplo espectro da literatura clássica greco-latina, assim como também dos escritos bíblicos. Em especial, a mitologia clássica (a que dedicou seu De sapientia veterum (1609) - Da sabedoria dos antigos) foi um de seus recursos predilteos na (...) hora de valer-se de alegorias para tornar acessível a um público amplo e não especializado os conteúdos mais inovadores, profundos e abstrusos de sua filosofia.1 Tudo isso converte algumas de suas obras em excelentes peças da literatura filosófica, nas quais Bacon põe em prática sua grande plasticidade como escritor, que, delicadamente e sem tropeços, transporta seus leitores da beleza da poesia e fantasia para os conceitos mais abstratos, sempre em busca de representar suas ideias filosóficas e de transformar a realidade por meio delas. Neste texto, apresentarei brevemente algumas das imagens pelas quais ele quis retratar aspectos fundamentais do seu projeto de restauração do saber. (shrink)

This chapter focuses on the appetite for self-preservation and its central role in Francis Bacon’s natural philosophy. In the first part, I introduce Bacon’s classification of universal appetites, showing the correspondences between natural and moral philosophy. I then examine the role that appetites play in his theory of motions and, additionally, the various meanings accorded to preservation in this context. I also discuss some of the sources underlying Bacon’s ideas, for his views about preservation reveal traces of Stoicism, Telesian natural (...) philosophy, the natural law tradition, as well as late-scholastic ideas. Bacon assumes the existence of two kinds of preservation: self-preservation and preservation of the whole. The appetite through which the whole preserves itself overpowers individual appetites for self-preservation. In Bacon’s theory of motions, the primacy of global preservation – that is, the preservation of the whole – is evidenced by the way matter resists being annihilated, while self-preservation at a local and particular level is revealed through other kinds of motion. Bacon’s notion of appetite reflects a specific metaphysics of matter and motion, in which the preservation of natural bodies follows teleological patterns shared by both nature and humanity: the preservation of the whole is the highest goal, both in moral and natural philosophy. In this chapter, I argue that in Bacon’s natural philosophy different kind of things, including nature and humans, are ruled by patterns that are constitutive of correlated orders, neither of which is reducible to the other: there is no priority of the natural order over the moral, or vice versa. Thus, at a more general level, both are expressions of the same type of divinely imposed, law-like behaviour. (shrink)

Finality, design and purpose have started to be excluded from the language of the natural sciences since the XVIIth century. Darwin succeeded in excluding them from his theory of evolution appealing to a blind and mechanical natural selection. Today, the most usual definitions for the concept of biological function take for granted that functions: 1) are not dependent on a goal; 2) are not dependent on observers, but only on nature; 3) are explicable in causal terms, either with reference to (...) the causal history of the organ (etiological definition), or with reference to its present structure and causal capabilities (dispositional definition). However, we shall see that such presuppositions cannot take into account the normative character of the concept of biological function. We show that a generalization of the concept of scientific objectivity lets us affirm that functions: 1’) are dependent on a goal; 2’) are dependent on both observers and nature; 3’) cannot be reduced to causality, nor break the laws of physics; and yet, 4) are truly objective. Broadly speaking, “empiricism” is a label that usually denotes an epistemological view that emphasizes the role that experience plays in forming concepts and acquiring and justifying knowledge. In contemporary philosophy, there are some authors who call themselves as empiricists, although there are differences in the way they define what experience consists in, how it is related to theory, and the role experience plays in discovering and justifying knowledge, etc. (e.g., Ayer 1936; Van Fraassen 2002). In contrast, in the early modern (...) period, empiricism was not a label that philosophers traditionally characterized until nowadays as empiricists (most famously, John Locke, George Berkeley, and David Hume) used to describe their doctrines. Indeed, as attributed to early modern philosophical authors, empiricism is not an actor’s category, but an analytic historiographical category retrospectively applied to them and confronted to rationalism, whose main representatives were considered to be Rene Descartes, Baruch Spinoza, and G.W. Leibniz. Such a narrative began to be established by the late nineteenthcentury and described early modern empiricism as an epistemological stance maintaining (1) that the origin of all mental contents lies in experience (a genetic statement), and (2) that knowledge can only be justified a posteriori (an epistemic statement). This entails that empiricists deny the existence of innate mental contents and the possibility of a purely a priori knowledge. In the history of early modern science such a dichotomy has been usually rendered in terms of the opposition between continental rationalist Cartesian science vs British empiricist Newtonian science. In the last four decades, many aspects of this traditional narrative have been criticized, and the meaning of early modern empiricism is subject of renewed studies. (shrink)

The historiographical narrative describing early modern European philosophy as the confrontation between rationalism and empiricism and its overcoming through the Kantian synthesis had a huge spread in Argentina. This article investigates the genesis of this traditional account in the universities of Córdoba, Buenos Aires and La Plata between 1780 and 1920. It offers an introduction concerning the formation of this narrative in Europe and a survey of the teaching of early modern philosophy in Argentina during that period. It concludes that, (...) although some of its components are found during the nineteenth century, it was only in the second decade of the twentieth century that the traditional narrative was formulated in its entirety, in parallel with the introduction of Kantianism in Argentine. However, the construction of this narrative is not merely explained by this fact but also by the weight that the history of philosophy gained in the syllabus as part of the demands involved in the shaping of the academic philosophical field. Finally, this paper suggests ways to reconfigure and renew the canon. (shrink)

Background Consent policies for post-mortem organ procurement (OP) vary throughout Europe, and yet no studies have empirically evaluated the ethical implications of contrasting consent models. To fill this gap, we introduce a novel indicator of governance quality based on the ideal of informed support, and examine national differences on this measure through a quantitative survey of OP policy informedness and preferences in seven European countries. -/- Methods Between 2017–2019, we conducted a convenience sample survey of students (n = 2006) in (...) Austria (AT), Belgium (BE), Denmark (DK), Germany (DE), Greece (GR), Slovenia (SI) and Spain (ES), asking participants about their donation preferences, as well as their beliefs and views about the policy in place. From these measures, we computed indices of informedness, policy support, and fulfilment of unexpressed preferences, which we compared across countries and consent systems. -/- Results Our study introduces a tool for analyzing policy governance in the context of OP. Wide variation in policy awareness was observed: Most respondents in DK, DE, AT and BE correctly identified the policy in place, while those in SI, GR and ES did not. Respondents in opt-out countries (AT, BE, ES and GR) tended to support the policy in place (with one exception, i.e., SI), whereas those in opt-in countries (DE and DK) overwhelmingly opposed it. These results reveal stark differences in governance quality across countries and consent policies: We found a preponderance of informed opposition in opt-in countries and a general tendency towards support–either informed or uninformed–in opt-out countries. We also found informed divergence in opt-in countries and a tendency for convergence–either informed or uninformed–among opt-out countries. -/- Conclusion Our study offers a novel tool for analyzing governance quality and illustrates, in the context of OP, how the strengths and weaknesses of different policy implementations can be estimated and compared using quantitative survey data. Este capítulo se propone explorar cómo el replanteo de las causas finales en la ciencia natural suscitado por la Revolución Científica impactó en el desarrollo del materialismo y el ateísmo del Siglo de las luces. Con el surgimiento de la ciencia moderna en Europa, en el siglo XVII ocurrieron cambios sustantivos en la concepción de la causalidad. Ciertos estudios pioneros sobre el tema, sostenían que la nueva ciencia anulaba las causas finales y establecía que todos los fenómenos naturales debían explicarse (...) en términos de materia y movimiento (Burtt, 1952:98‒99; Schmitt, 1983:5). Más tarde, otros especialistas —con argumentos más sólidos y pruebas más convincentes— mostraron que la causalidad final no fue anulada por completo; siguió presente en muchos autores, aunque ya no como parte indispensable de la explicación científica, sino como un componente ontológico de la naturaleza (Osler, 1996 y 2001). Ahora bien, ¿qué sucedió con las causas finales en el siglo XVIII europeo, época de profundas turbulencias políticas y controversias filosóficas, en la cual el materialismo, el ateísmo y el deísmo fueron ganando terreno? Para hacer un recorte dentro de la vasta variedad de posiciones existentes en este escenario, comenzaremos por repasar la posición sobre las causas finales de Francis Bacon (1561‒1626), quien fue una figura muy influyente en la Ilustración. 2 Luego, analizaremos la recepción de esa posición por parte de algunos autores británicos (D. This chapter explores the representations of the Renaissance developed by two prominent intellectuals in Argentine philosophy during the first three decades of the twentieth century: José Ingenieros and Alejandro Korn. Their work is contrasted with that of a nineteenth- century Spanish source that served as the basis for their own performances, Marcelino Menéndez Pelayo. It will highlight how these authors articulated the ideas and ideals of the Renaissance with the construction of a national thought and culture. For the Argentines it (...) was important to understand how the Renaissance was perceived in Spain, the country that set the course for the predominant ideas in Argentina in the colonial period between the sixteenth and eighteenth centuries. Menéndez Pelayo devoted special attention to the Renaissance because there he finds the highest and most genuine moment of the Spanish intellectual history. All three thinkers are interested in weighing the differences between the Renaissance and the Counter-Reformation, and their impact in the construction of the national culture of their countries, both Spanish and Argentine. Regardless of their philosophical, political and religious differences, the historical narratives of these authors used the Renaissance ideologically, and made of it a conceptual motive, an inspiring model containing the values to be embodied by the culture of their nations, above all the value of “free inquiry”. In this paper we explore the absentminded driver problem using two different scenarios. In the first scenario we assume that the driver is capable of reasoning about his degree of absentmindedness before he hits the highway. This leads to a Savage-style model where the states are mutually exclusive and the act-state independence is in place. In the second we employ centred possibilities, by modelling the states (i.e. the events about which the driver is uncertain) as the possible final destinations indexed (...) by a time period. The optimal probability we find for continuing at an exit is different from almost all papers in the literature. In this scenario, act-state independence is still violated, but states are mutually exclusive and the driver arrives at his optimal choice probability via Bayesian updating. We show that our solution is the only one guaranteeing immunity from sure loss via a Dutch strategy, and that – despite initial appearances – it is time consistent. This raises important implications for the rationality of commitment in such scenarios. (shrink)

Background: Several countries have recently changed their model of consent for organ donation from opt-in to opt-out. We undertook a systematic review to determine public knowledge and attitudes towards these models in Europe. Methods: Six databases were explored between 1 January 2008 and 15 December 2017. We selected empirical studies addressing either knowledge or attitudes towards the systems of consent for deceased organ donation by lay people in Europe, including students. Study selection, data extraction, and quality assessment were conducted by (...) two or more reviewers independently. Findings: Awareness of the consent model was lower in opt-out countries than in opt-in countries. A majority of the public agrees with opt-in, regardless of the law in their own country. There are ambivalent attitudes regarding the opt-out system. The public tend to prefer opt-in and mandatory choice over opt-out when several options are offered. Interpretation: The assumption that people in opt-out countries are aware of the legal requirements to be excluded from the pool of potential donors is not supported by the results of this review. This is a concern, since ignorance hinders people's autonomy regarding organ donation decision-making. Higher awareness of consent model in opt-in countries may reflect greater efforts to inform the public through campaigns to motivate donation. Legal moves towards opt-out are at odds with people's expressed preferences. Main limitations of this review are the lack of data from some countries, study population heterogeneity, and methodological shortcomings. (shrink)

The Sleeping Beauty problem has attracted considerable attention in the literature as a paradigmatic example of how self-locating uncertainty creates problems for the Bayesian principles of Conditionalization and Reflection. Furthermore, it is also thought to raise serious issues for diachronic Dutch Book arguments. I show that, contrary to what is commonly accepted, it is possible to represent the Sleeping Beauty problem within a standard Bayesian framework. Once the problem is correctly represented, the ‘thirder’ solution satisfies standard rationality principles, vindicating why (...) it is not vulnerable to diachronic Dutch Book arguments. Moreover, the diachronic Dutch Books against the ‘halfer’ solutions fail to undermine the standard arguments for Conditionalization. The main upshot that emerges from my discussion is that the disagreement between different solutions does not challenge the applicability of Bayesian reasoning to centered settings, nor the commitment to Conditionalization, but is instead an instance of the familiar problem of choosing the priors. As Derrida points out, since Aristotle touch has been qualified as ἄδηλον: secret, nocturnal, barely apparent. After some brief etymological remarks, in this article, I explore the mystery that touch represents for language through Levinas’ concept of the secret, thematizing two levels: first, that of the contemporary critique of ocularcentrism, then the level of the tactile experiences that can hardly be (...) put into words. Families play an essential role in deceased organ procurement. As the person cannot directly communicate his or her wishes regarding donation, the family is often the only source of information regarding consent or refusal. We provide a systematic description and analysis of the different roles the family can play, and actions the family can take, in the organ procurement process across different jurisdictions and consent systems. First, families can inform or update healthcare professionals about a person’s donation wishes. Second, families (...) can authorize organ procurement in the absence of deceased’s preferences and the default is not to remove organs, and oppose donation where there is no evidence of preference but the default is to presume consent; in both cases, the decision could be based on their own wishes or what they think the deceased would have wanted. Finally, families can overrule the known wishes of the deceased, which can mean preventing donation, or permitting donation when the deceased refused it. We propose a schema of 4 levels on which to map these possible family roles: no role, witness, surrogate, and full decisional authority. We conclude by mapping different jurisdictions onto this schema to provide a more comprehensive understanding of the consent system for organ donation and some important nuances about the role of families. This classificatory model aims to account for the majority of the world’s consent systems. It provides conceptual and methodological guidance that can be useful to researchers, professionals, and policymakers involved in organ procurement. (shrink)
